Clearinghouse queries: the annual check most small fleets miss

Nothing reminds you. Nothing breaks when you skip it. It is discovered at an audit, where it is a countable violation with a date on it.

Two different queries, and only one of them announces itself

The FMCSA Drug and Alcohol Clearinghouse involves two obligations that carriers routinely collapse into one.

The pre-employment query happens when you hire. It is a full query, it needs the driver's specific consent, and it is impossible to forget because the hire is blocked without it.

The annual query is the one that disappears. Once a year, for every CDL driver you employ, you must query the Clearinghouse. Nothing prompts it. No load is blocked. No system complains. The only thing that happens if you skip it is nothing — until an auditor counts.

Yes, this applies to a one-truck operation

If you hold your own authority and you drive your own truck, you are both the employer and the CDL driver. The requirement attaches to the employer, and you are it.

This is the single most common gap we find when we take on an owner-operator who has been running two or three years. They registered with the Clearinghouse at the start, did the pre-employment query on themselves, and then nothing — because the annual obligation genuinely never came up again.

Being the owner does not exempt you from querying yourself. It is a strange requirement to sit with, and it is still the requirement.

Why it is a bad violation to have

Most compliance findings involve judgement. Was the file adequate. Was the review meaningful. Was the record sufficient. There is room to explain.

A missing annual query has none of that. It is binary, per driver, per year, with a date. Either the query exists in the Clearinghouse record or it does not, and the auditor is reading the same system you would be.

For a fleet of six drivers who have run three years without annual queries, that is eighteen discrete, undeniable violations sitting in a federal database. There is no version of that conversation that goes well.

Fixing it takes an afternoon

If you are behind, the fix is not complicated: make sure you are registered as an employer, make sure each driver is registered and has given the consent their query type requires, run the queries, and put the next one in a calendar that will actually fire.

You cannot retroactively create a query for a year that has passed — the record shows when it was run. What you can do is stop the count growing, and be able to show an auditor that the system now runs.

The structural fix is to stop relying on memory. Annual obligations that nothing enforces are exactly the obligations a working carrier drops, and there is no discipline that survives a bad month on the road.

Clearinghouse query types, consent rules and timing are set by FMCSA and have changed since the system launched. Confirm the current requirement for your operation rather than working from a procedure you learned once.
